These Terms of Service ("Terms") apply to creekside-nursery.com, our live availability page, our text messaging program, and all sales by Creekside Nurseries LLC ("Creekside," "we," "us"). Creekside Nurseries LLC is a wholesale, trade-only nursery based in Laurel, Maryland, serving trade customers in Maryland, Virginia, Pennsylvania and the District of Columbia. By using our website, requesting a quote, placing an order, or opting in to text messages, you agree to these Terms.

Trade-only accounts

We sell wholesale to the trade only, including landscapers, contractors, garden centers, designers, municipalities and other qualified businesses. We may ask for business details, such as a business license or resale certificate, before we open an account, and we may approve, decline or close accounts at our discretion. You are responsible for keeping your account information accurate and your live availability login secure.

Quotes and orders

Availability shown on our website or live availability page is for information only and may change without notice. An order is confirmed only when it appears on a written quote or invoice from Creekside Nurseries LLC. Quantities, sizes, terms and timing are as stated on that written quote or invoice. Plants are living products, so natural variation in shape, color and form is normal.

Delivery

Free delivery on qualifying orders. Ask us for details. Delivery dates and windows are confirmed when your order is scheduled and depend on availability, weather and route. Someone must be on site to inspect and sign for the delivery, and the delivery site must be safely accessible to our trucks.

Pickup

Orders may be picked up at our Laurel, MD yard, or in Berryville, VA or Crisfield, MD, by arrangement. Contact us to schedule a pickup. Pickup times are confirmed with your order.

Claims policy

Please inspect your plants at delivery or pickup. Any problem, including shortages, damage, or size or variety concerns, must be reported at the time of delivery or pickup, before you sign the delivery or pickup ticket. Signing the ticket confirms that the order was received complete and in acceptable condition. All sales are final, and there are no refunds. After plants leave our care, we are not responsible for planting, watering, site conditions, weather or aftercare.

Use of the website

You may use our website and live availability page for lawful business purposes related to buying from Creekside. You may not copy, scrape, resell or misuse our content, photos, availability data or logins, or interfere with the site's operation. Website content is provided "as is" and may contain errors or change without notice. Links to other sites are provided for convenience, and we are not responsible for their content.

Text messaging (SMS) terms

Program. Creekside Nurseries LLC sends text messages to trade customers about order, quote and delivery updates, and for customer care.

How you opt in. You opt in to receive text messages from Creekside Nurseries LLC by providing your mobile number through our website forms or by texting us at (443) 586-7022. Consent to receive texts is not a condition of any purchase.

Message frequency. Message frequency varies based on your orders, quotes and requests.

Costs. Message and data rates may apply.

Opt out. Reply STOP to any message to opt out. You will receive one confirmation message, and then no further texts unless you opt in again.

Help. Reply HELP for help, or contact us at (443) 586-7022 or ops@creekside-nursery.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy. Mobile numbers and opt-in consent are not shared with or sold to third parties for marketing purposes. Our Privacy Policy explains how we handle information.

Limitation of liability

To the fullest extent permitted by law, Creekside Nurseries LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or business, arising from our website, text messages or products. Our total liability for any claim related to an order will not exceed the amount you paid for the specific products involved in that claim.

Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Maryland.

Changes to these terms

We may update these Terms. The effective date above shows when they were last changed. Continued use of our website or services after a change means you accept the updated Terms.
