End-User License Agreement and Terms of Use

Effective October 10, 2026

This End-User License Agreement and Terms of Use ("Agreement") governs your use of creekside-nursery.com, the Creekside live availability page, and any related Creekside web applications and integrations (together, the "Service"), operated by Creekside Nurseries LLC ("Creekside," "we," "us"), Laurel, Maryland. By using the Service, you agree to this Agreement.

License

Subject to this Agreement, Creekside grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your business's own purchasing with Creekside. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works of the Service. All rights not expressly granted are reserved by Creekside. This license ends automatically if you breach this Agreement or your account is closed.

Trade-only service

Creekside is a wholesale, trade-only nursery. Trade accounts are for businesses and require a valid business license. We may approve, decline, suspend, or close any account at our discretion.

Accounts and access

Access to the live availability page is by invitation for approved accounts. Keep your login private, and don't share access with others. You are responsible for activity under your account.

Availability, quotes, and orders

Availability, plant photos, sizes, and other information are provided for convenience and can change without notice. Photos show the variety, not the exact plant you'll receive. A quote is not a confirmed order. Orders are confirmed only when we accept them, and they're subject to availability and our quote, invoice, delivery, and payment terms.

Acceptable use

Don't misuse the Service: no unauthorized access, sharing logins, scraping, interference with its operation, or unlawful use. We monitor account activity, and suspicious, unusual, or unethical activity may result in immediate suspension or termination of your account and access, without notice.

Intellectual property

The site's content, including our name, logo, text, and images, belongs to Creekside or its licensors. Don't copy or reuse it without permission.

Third-party services

The Service may link to or rely on third-party services, such as social media, hosting, and accounting providers, including Intuit QuickBooks, which Creekside uses for its internal accounting. We're not responsible for their content or practices.

Disclaimer and limitation of liability

The site is provided "as is," without warranties of any kind. To the fullest extent allowed by law, Creekside is not liable for indirect, incidental, or consequential damages arising from use of the site. Our total liability for any claim related to the site is limited to $100.

Governing law

This Agreement is governed by the laws of the State of Maryland.

Termination

We may suspend or end your access to the Service at any time. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Changes

We may update this Agreement. The effective date above shows when they were last changed. Continued use means you accept the updated Agreement.
